ParkingMeter Terms of Use

Article 1 (Application)

1. These Terms apply between us and the user in relation to the use of the App. Any guidance or notices we separately provide in the App or elsewhere also form part of these Terms.
2. The App is distributed through the App Store, and the user shall also comply with the terms established by Apple Inc.

Article 2 (Purpose of the App and the nature of its fee calculations)

1. The App is intended to calculate and display an estimate of parking fees based on the tariff the user configures or imports.
2. Amounts, durations, and maximum charges shown are estimates only and do not guarantee the amount actually charged at the car park. Actual charges may differ due to incorrect tariff settings, misreading of a fee sign, revisions to the tariff, differences in calculation method, and other causes.
3. The final fee is always as shown on the car park's own fee sign and payment machine.

Article 3 (Fee-sign reading via OCR / AI)

1. The App's sign-reading features (on-device analysis and the paid cloud AI analysis) do not guarantee the accuracy of the results.
2. Users should review and correct the extracted results before relying on them.

Article 4 (Paid subscription — Premium)

1. The App offers a paid subscription (“Premium”) that includes higher-accuracy sign reading via cloud AI and other features.
2. Billing is processed through Apple's App Store (Apple Inc.). The price, term, and availability of any free trial are shown in the App and on the App Store at the time of purchase.
3. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Renewal is charged to the user's Apple Account at the end of the current period.
4. Cancellation is available from “Settings > Apple ID > Subscriptions” on iOS. Where a free trial applies, no charge is incurred if the subscription is cancelled during the trial period.
5. Handling of billing and refunds through Apple is governed by Apple's own terms, including the Apple Media Services Terms and Conditions.

Article 5 (Prohibited conduct)

In using the App, the user shall not engage in any of the following:

1. Conduct that violates laws or public order and morals
2. Placing an excessive load on the App or our servers, unauthorized access, reverse engineering, and similar acts
3. Improperly circumventing or altering the functions of the App
4. Any other conduct we deem inappropriate

Article 6 (Intellectual property)

Intellectual property rights in the App and its programs, designs, trademarks, and related materials belong to us or to their rightful owners. Users may not reproduce, modify, or redistribute them without our permission.

Article 7 (Disclaimer)

1. We make no warranty, express or implied, as to fitness for a particular purpose, accuracy, completeness, or availability in providing the App.
2. Except in cases of our willful misconduct or gross negligence, we are not liable for damages arising from use of or inability to use the App, including damages arising from a difference between the displayed amount and the actual parking fee.
3. The App may not operate correctly depending on the OS, device, network conditions, or external services such as AI analysis services and map apps.

Article 8 (Changes, suspension, and termination of the service)

We may change the content of the App, or suspend or terminate its provision, without prior notice to users. We are not liable for damages arising to users as a result beyond the scope set out in the preceding article (Disclaimer).

Article 9 (Changes to these Terms)

We may amend these Terms as necessary. Material changes will be announced in the App or through the App Store listing. Continued use of the App after a change constitutes agreement to the amended Terms.

Article 10 (Use through the App Store)

1. Apple Inc. has no obligation to furnish any maintenance or support services with respect to the App.
2. We, not Apple, are responsible (to the extent set out in these Terms) for addressing any claims relating to the App, including product liability, legal or regulatory non-compliance, and third-party intellectual property infringement.
3. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, have the right to enforce these Terms against you.

Article 11 (Governing law and jurisdiction)

1. These Terms are governed by the laws of Japan.
2. Any dispute between us and a user regarding the App shall be subject to the exclusive jurisdiction of the Saitama District Court as the court of first instance.
